Green Trade and Sustainable Investments: Legal Pathways for Environmental Protection
Abstract
The intersection of trade, investment, and environmental protection represents one of the most critical challenges in the global push for sustainable development. While international trade and investment have driven economic growth and globalization, they have also contributed to environmental degradation, resource exploitation, and climate change. This tension underscores the urgent need for robust legal frameworks that harmonize economic objectives with environmental sustainability. This study examines legal frameworks’ evolution, efficacy, and challenges for environmental protection in trade and investment. It evaluates key international instruments, such as trade-related environmental provisions in World Trade Organization (WTO) agreements, bilateral investment treaties (BITs), and regional trade agreements (RTAs), highlighting their potential to promote environmental objectives. The analysis also considers soft law instruments, such as the United Nations Sustainable Development Goals (SDGs) and principles from international environmental law, including the precautionary principle and the polluter-pays principle. A central focus is the balance between liberalization and regulation—how to ensure environmental protections without undermining the economic benefits of trade and investment. The paper also critiques existing frameworks for their gaps and inconsistencies, particularly in addressing the environmental impacts of transnational corporations, the exploitation of natural resources, and the challenges posed by investor-state dispute settlement (ISDS) mechanisms. To move forward, this work proposes a paradigm shift in trade and investment law, advocating for stronger environmental safeguards, binding commitments to sustainability, and integration of climate change mitigation measures. It also emphasizes the role of developing countries in shaping future frameworks to ensure equity and inclusivity. This paper calls for urgent legal innovation to align trade and investment with global environmental imperatives, fostering a system that supports economic growth while safeguarding the planet for future generations
